The Bigger Picture

Welfare Fund Act & Guidelines

The Advocates Welfare Fund Act, 2001, provides for the constitution of a welfare fund for the benefit of advocates. State Bar Councils across India are increasingly implementing state-specific schemes to address the financial challenges faced by legal professionals.

The Bar Council of India has recently issued guidelines urging state governments to provide a minimum stipend of ₹5,000 for junior advocates to ensure they can sustain their practice during the initial struggling years.

Common Questions

Understand how these schemes work across different states.

Eligibility varies by state. Generally, newly enrolled advocates (below a certain age) are eligible for stipends, while senior advocates (usually 65+) who have surrendered their license are eligible for pensions. Most schemes require active membership in the State Bar Council.

For most modern stipend schemes (like Bihar's), passing the All India Bar Examination (AIBE) within two years of enrollment is a mandatory condition to continue receiving the benefits.

Applications are usually processed through the respective State Bar Council or the Advocate Welfare Fund Trustee Committee. You typically need to submit an application form along with supporting documents (Enrollment certificate, AIBE result, Identity proof) through your local Bar Association.
